Terms of Service
Last updated: September 18, 2026 · Turnout Ops
1. Agreement
By accessing Turnout Ops you agree to these Terms on behalf of yourself and, if applicable, your fire department. If you do not agree, do not use the service. Operator: Ethyn Birch (“Turnout Ops”, “we”), Eddington, Maine. Contact: support@turnoutops.com · Sales: sales@turnoutops.com.
2. The service
Turnout Ops provides web-based department operations tools for small fire departments. The current product includes Foundation and optional add-on modules (Checklists, Inventory, and Training), which may also be purchased together as Full Ops. Optional one-time services (department setup and call history import) may be purchased separately. List prices appear on the site; a Stripe invoice controls if amounts differ for a department. Modules listed as “Coming soon,” if any, are not sold until offered.
Turnout Ops is not a substitute for official CAD, dispatch, radio, or emergency communications systems.
3. Accounts & departments
- You may create an account and a department self-serve. Optional sales-assisted setup is available if you want it; it is not required to start.
- Joining an existing department is invite-based; keep credentials confidential.
- Roles control permissions within your department.
- You are responsible for content your members enter and for only storing information you are authorized to keep.
4. Subscriptions, services & billing
Foundation and optional add-on subscriptions (Checklists, Inventory, Training, or Full Ops) are billed monthly or yearly as described on the site (yearly billing may be offered at roughly 10× monthly). You may start self-serve checkout or contact sales for optional setup help. Optional one-time services currently include department setup ($49), call history import ($99), or both together ($129). Actual amounts on a Stripe invoice control if they differ from the website for a specific order.
- Subscriptions (monthly or yearly): no refunds once a billing period has started. If you cancel, access continues through the end of the paid period; the subscription does not renew afterward.
- Setup and import services: non-refundable once work has started.
- Failed payment may result in suspension of paid access.
- Taxes may apply where required.
5. Acceptable use
- Use only for lawful fire department / public-safety operations purposes
- Do not attempt to access other departments’ data or bypass entitlements
- Do not upload malware, scrape abusively, or disrupt the service
- Do not misrepresent your role or department affiliation
6. Intellectual property
Turnout Ops software, branding, and documentation remain our property. Department-entered operational data remains owned by the department / applicable public entity, subject to these Terms and our Privacy Policy.
7. Confidentiality & data
We process personal and operational data as described in the Privacy Policy. After cancellation, we delete or anonymize department data within 60 days as described there, subject to legal and backup exceptions.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 months before the claim. Some jurisdictions do not allow certain limitations.
10. Indemnity
You agree to indemnify and hold harmless Ethyn Birch / Turnout Ops from claims arising from your misuse of the service, violation of these Terms, or content you submit, to the extent permitted by law.
11. Suspension & termination
We may suspend or terminate access for breach, non-payment, or risk to the platform. You may stop using the service at any time.
